Sufficient Evidence Is In For The FAA To Ground Boeing's 737 MAX 8 In U.S. Of A.

"Two pilots reported their aircraft unexpectedly pitched nose down after engaging autopilot following departure. Another pilot reported a “temporary level off” triggered by the aircraft automation. The captain of a November 2018 flight called part of the aircraft’s flight manual “inadequate and almost criminally insufficient.”

“The fact that this airplane requires such jury rigging to fly is a red flag,”  he wrote in a report to the federal Aviation Safety Reporting System. The patter of PR from the FAA and its  Neoliberal enablers is that (WSJ today, p. A1):

"The investigation has just begun and to date we have not been provided data to draw any conclusions or take any actions."

Which is utter bollocks, and indeed in the wake of Britain and EU nations now taking action, i.e.  in the  former not only grounding its own MAX 8 flights, but barring others (from other nations) from entering- is less and less cogent as an excuse.  Not to mention after the Chinese aviation authority explained their grounding decision - of their entire fleet of MAX 8 jetliners- was based not only on the Ethiopian crash that took 157 lives. It was also based on (ibid.):

 "previously unreported incidents in which Chinese 737 Max pilots received unreliable readings from sensors used to ensure the aircraft is flying at the correct angle."

Let us also quickly note the same dismissal -what I call "first world chauvinism"-   cannot be invoked here, i.e. "this is just a training and culture issue, ya know black and brown people lack proper experience and training.".  It can't because nearly all Chinese commercial pilots are former military jet aircraft pilots with thousands of hours experience in all manner of conditions, weather etc.  That the sensors gave "unreliable" readings is also extremely concerning given a correct response to incorrect readings could well trigger the computerized MCAS   ("Maneuvering Characteristics Augmentation System')  that was tagged in the earlier Lion Air crash.  It is almost certainly implicated in the Ethiopian crash as well, given the observed steep angle and  difficulty reported in vertical attitude control.  Which suggests a factor directly connected to the plane's "angle of attack".

Another aspect: both crashes occurred soon after take off, within minutes, when the aircraft  was trying to attain a proper lift and ascent angle. This is also the interval when other factors most directly come into play, namely the plane's load (total weight) , as well as g- forces and how these combine to either enable sufficient liftoff speed, or - possibly in the case of the Ethiopian crash --  create too slow a speed,  interpreted as a stall by the MCAS.  In this case, the MCAS will automatically kick in to aim the jet nose downwards and affect vertical stability. 

 It can also kick in if the pilot is manually flying the plane and sensors detect the nose of the plane is too high, i.e. the angle of attack is too great.  In such an event the nose of the plane is automatically pushed down.. It is interesting here that in both the Lion Air and Ethiopian crashes the ends arrived in literal nose dives - one into the Java Sea, the other into land (leaving a crater).  This attests to the fact the MCAS was indeed responsible, for whatever reason.

Here is something to think about:  What if - as in the case of the Chinese pilots (who reported "unreliable readings from sensors") - the Ethiopian pilot beheld the sensors relaying  (mistakenly) that the angle of attack for takeoff as too low..  Then,  taking the sensors to be accurate, he attempted to correct the angle by manually pointing the nose upward?  Well, as noted before,  the MCAS would be triggered, forcing the nose downward.  The pilot at this point may panic, and make an even greater effort to force the nose upward - but be overridden by the MCAS.  (Most recent reporting in the WSJ (3/13, p. A13) disclosed that in fact Boeing since learned the Lion Air angle sensors gave incorrect readings. Hence, the pilot responding to such incorrect readings would have initiated a catastrophe such as depicted in the top graphic.)

 The observations of Col. Stephen Ganyard (USMC, Ret.) last night on ABC news, spoke to the tragic outcome: "What we know is that soon after takeoff the plane was porpoising, moving up and down'.

 The erratic motion described  indicates the pilot was definitely struggling for control, perhaps trying to keep the plane's nose up, even as the automated MCAS  kept driving the nose down - until the plane finally went into steep descent into the ground.    Rachel Maddow's exposure (last night, MSNBC) of a publicly accessible pilot database- where U.S. pilots report aircraft issues  - also blows the lid off the claim from the FAA that the problems are limited or not serious, see  e.g.

Indeed, the fact so many pilots reported vertical control issues is damned troubling, i.e. from one pilot: 

"On Day 3 of 3 departing in a MAX 8  after a long overnight I was well rested At departure we had strong cross winds directly off the right wing.  The aircraft accelerated normally and the Captain engaged the 'A' autopilot after reaching set speed.  Within 2 to 3 seconds the aircraft pitched nose down.  I called 'descending' just prior to the GPWS (safety system) sounding 'don't sink, don't sink'. The Captain immediately disconnected the autopilot and pitched into a climb.

The remainder of the flight was uneventful.  We discussed the departure at length and I reviewed in my mind our automation setup and flight profile but can't think of anything that would pitch nose down so aggressively."  

The pilot's report is chilling to say the least, because it evokes thoughts of what the Indonesian (Lion Air) pilot and Ethiopian pilot may also have confronted.  Some may then ask, "Why didn't they just disconnect the autopilot?"  Hold strain there.  One experienced American pilot on the NBC Evening News Monday night admitted he "might not remember"  to do that, especially in an emergency situation.

All of this suggests a major design flaw in the aircraft which - it is true - may only be manifested in 10 out of 10,000 flights. But even that is too many given we are now supposedly in an era of unrivaled safety for commercial aviation.  That is,  essentially zero crashes unless the piloting human goes "haywire" and acts to take the plane down himself. (The classic case was Andreas Lubitz, Germanwings pilot who crashed his jet into a mountain on Oct. 9, 2015.  A similar situation likely accounted for Malaysian Flight 370 which vanished in 2014.  Almost certainly one or both pilots deliberately flew the jet way out of its intended course - for whatever reason.)

 All of this is why the FAA is making a major error in not  immediately  following the advice of Sens. Diane Feinstein and Blumenthal to ground the jets   This is especially pertinent now as we learn European authorities have now grounded the planes, following earlier moves by aviation regulators in China, Indonesia, Singapore and Australia to prohibit the jets from flying. In all, more than half of the 737 Max 8 aircraft in the world have been pulled from use since an Ethiopian Airlines plane crashed on Sunday, killing 157 people.

The one country holding back?   The United States.  Why? Because it doesn't give two shits about its citizens' safety, only profits from share prices. The WaPo reported Monday night Boeing asked the FAA not to ground planes because share prices would sink $5 billion or more.  There you have the reason in a nutshell for the FAA's refusal to act.

As with the case of privacy sharing of all our data, not to mention GMO foods, the Neoliberal narrative is that money matters over all else.  Citizen security and safety is a secondary issue, if that. Profits uber alles! This is in direct contradiction to the precautionary principle, i.e. it is the duty of the manufacturer to prove his product is safe, not for others to try prove it isn't.  Invoking this principle in good faith, the FAA as a genuine regulator invested first in public safety would ground all MAX 8 planes until the current investigation is complete.  By continuing to fly these planes despite the cumulative incidents (including the Chinese reports of inaccurate sensor readings) the FAA's actions border on the reckless and criminal.  

Ok, maybe we can only go so far as to assert myopic - i.e. seeing only monetary losses when one of the mandates for the establishment of the agency was:  making and enforcing safety policy.  However, the other was:  to "promote the business of aviation."  But as air travel specialist Peter Greenburg put it, "they can't do both". Indeed. So we see the agency bowing to Boeing's scare tactics pressure re: loss of share value, loss of profits.

This shtick is not too dissimilar from the FDA's when they agreed to corporate pressure (see '60 Minutes' and the interview with former FDA commissioner David Kessler)  to change the label on Oxycontin and other opioids (in 2000) from "use only short term" to "approved for long term use" e.g.





This  "opened the floodgates" to the opioid crisis (in Dr. Kessler's words).

Thus, in each case -  FAA and FDA  -  we behold federal agencies rendered captives to corporate powers.  This is likely on account of the revolving door between corporate lobbies and the agencies - with employees of the latter constantly moving to the former and back again.  At least Sen. Elizabeth Warren seems to grasp the principle, as she said earlier today:

"The world has now witnessed the second tragic crash of one of these planes in less than six months. While we do not know the causes of these crashes, serious questions have been raised about whether these planes were pressed into service without additional pilot training in order to save money. Today, immediately, the F.A.A. needs to get these planes out of the sky.”

The UK civil  aviation authority also respects its citizens, as it announced as prelude to its grounding the planes:

"Given the similarity of the two accidents, it has been decided that as a precautionary measure that all” 737 MAX flights “should stop until appropriate safeguards are in place. This is needed to assure the  that the aircraft involved are fully compliant with internationally recognized standards.”

Look, if nearly 350 lives were lost to terror attacks on planes in two incidents the authorities would be on this like a ton of hot bricks. But since money is involved, they stonewall.

  We essentially KNOW the FAA will act  as well if there's another crash of the MAX 8, especially with an American- based airline.  But the question for many of us is: Why wait for that to happen?   Why not act now as a precautionary response, until  all the data come in?

Well, money is the answer, of course!  It's all about the Benjamins!

The French Truck Killer - A Psycho, NOT A "Radical Jihadi" Terrorist

Andreas Lubitz  - deliberately killed 150 last year by crashing his jet airline into a mountain. Why wasn't his act deemed "terrorism"? Because he has a German name?


The front page of The Denver Post today led with the follow-up story about the  19-ton truck attack in Nice, France leaving 84 dead and over 200 injured, many critically. According to the Post (p. 1A): "French authorities continue to puzzle over why a deliveryman and petty criminal would have mounted a Bastille Day attack that left 84 dead."

The piece went on to note (p. 14A): "the 31-year old Mohammed Bouhlel wasn't known to intelligence services......nor was he ever placed on a watch list for radicalization".. Nor was there any evidence of Bouhlel contacting ISIS or using its terrorist website to plan or mount the attack. (The same Post piece points out that the only real weapon he possessed apart from the truck was a handgun. The rifles weren't real but "replicas" and the lone grenade was a dud. )

More to the point, the guy's whole history bespeaks more petty crimes "theft, vandalism" etc.  than highly motivated terror inclinations. In addition, we now know in the weeks before, his wife broke up with him and he also lost his job as a trucker.  All of this adds up to a severely depressed guy who just happened to have a Muslim name, but not a terrorist.

This was also reinforced in a front page New York Times story ('A Surly Misfit With No Terror Ties, Turned A Truck Into A Tank') noting:

"He was known to his neighbors only as moody and aggressive oddball. He never went to the local mosque, grunted in response to greetings and sometimes beat his wife until she left him".

Sounds like a surly nutcase to me, not a jihadi terrorist. The Times adds: "Even French authorities had much the same view - definitely trouble but not a grave menace to the nation."

Marc Theissen of the WaPo has noted an ISIS "handbook" (Inspire)  for terror attacks and plans, but despite his conjecture there is no evidence at all that Bouhleil was privy to its contents or schemes.

Where have we seen this M.O. before, of a mass slaughter by a psychotic or depressed person? Well, last year with Andreas Lubitz  who deliberately crashed his Germanwings jet into into the side of a mountain in the French Alps killing all 150 people on board.  For a very brief time that also was thought to be an act of terror, until it was subsequently learned the guy was being treated for severe depression and a form of psychosis.

Indeed, German sources subsequently reported Lubitz had had a "psychotic episode". The German paper Die Welt reported he was being treated for "severe psychosomatic illness" and actually had been prescribed anti-psychotic meds for "strong subjective overload syndrome" . He tossed his meds away along with the prescriptions (according to the reports).  In addition, he'd received a medical note of dispensation that he was unfit  to fly- including on the day he arrived for the Dusseldorf flight!  In other words, this psycho never should have been anywhere near the plane - far less inside the cockpit.

Reinforcing this, clinical psychologist Dr. Ruth Wittersgreen proposed at that time how the psychotic episode would have unfolded. First, there would be Lubitz dealing day to day with the stress of hiding his severe mental illness (which was so severe he had to be monitored over time) from the company. Second, if he fell into a pattern of sleep deprivation this would have directly triggered the "psychotic episode".

Amdist all this many asked, as one expert did on CNN the morning after:

"Why this tragic communications breakdown between those treating Lubitz and the airline?"

Indeed. And here we also have parallels with the case of Aurora mass killer James Eagen Holmes, who was also being treated for severe psychological illness (at the Univ. of Colorado, Anschutz campus) prior to his rampage at an Aurora theater, slaying 12 and severely wounding dozens.  Why wasn't this information passed on to the proper authorities?

The horrific mass slaughter last year might also have been prevented had people -e.g.  at least one of his ex-girlfriends, spoken the hell up after he was claimed to have said.

"After tomorrow everyone will remember my name."

Now, in the case of Mohammed Bouhlel, it appears from the information we do know (reported by his family living in Tunisia, and related on MSNBC two nights ago), he had been "severely depressed" for months and he likely went over the top - or into the pits - after his separation from his wife and loss of job. In addition, his family didn't believe he'd been taking meds for his ongoing depression.

Then, just as German Andreas Lubitz  took out his psychosis and depression on 150 innocents, so did Mohammed Bouhlel take out on his on 84 - killed, and hundreds of others injured.

My point is we must not be misled into jumping to a "terror" conclusion merely because the offender happens to have a Muslim name. Such conflationary thinking - minus ancillary evidence (e.g. of being radicalized or making contact with ISIS) will only lead us to see terrorism in every mass killing act. Yes, ISIS insisted they were responsible, but what would you expect them to say as a terror group? They will always claim credit for any random act of butchery or mayhem, thereby exploiting the terror meme even if they weren't responsible in any way.

In retrospect then if we declined to call "terror" on  Andreas Lubitz' act of killing 150 by deliberately  crashing his jet last year, we can only do the same with Mohammed Boulhlel. That is, unless definitive evidence to the contrary turns up of actual connections and contacts with ISIS, say via evidence on laptops that he had been following them..

Up to now that has not appeared, so it makes more sense to treat his act like we did Andreas Lubitz', and acknowledge a too ready penchant to call "terror" on every act of mass violence. By over inflating acts of terror and especially crediting the ISIS vermin with dastardly acts actually committed by one or other form of psycho, we play right into the bastards' hands!

The Crazy In The Cockpit: Could This Air Tragedy Have Been Prevented?

The name "Andreas Lubitz"  will now live on in infamy along with that of Timothy McVeigh, Adam Lanza (Newtown massacre),  James Eagen Holmes  and Eric Harris and Dylan Kliebold, the Columbine killers. As most of us are now aware, this Lubitz melted down just after the Germanwings flight took off from Barcelona, Spain, en route to Dusseldorf, Germany. After locking the pilot out of the cockpit he set the altimeter's  automatic flight path on a dive to 100' altitude. Of course, as we know, in a place like the French Alps, no such altitude would be reached and the jet actually crashed into the side of a mountain at about 4,000 ft. with all 150 lost.

The evidence now in, from German sources and others, is the guy had a "psychotic episode". The German paper Die Welt reported today he was being treated for "severe psychosomatic illness" and actually had been prescribed anti-psychotic meds for "strong subjective overload syndrome" . He tossed his meds away along with the prescriptions (according to reports).  In addition, he'd received a medical note of dispensation that he was unfit  to fly- including on the day he arrived for the Dusseldorf flight!  In other words, this psycho never should have been anywhere near the plane - far less inside the cockpit.

Reinforcing this, yesterday morning  on MSNBC, the clinical psychologist Dr. Ruth Wittersgreen proposed how the psychotic episode would have unfolded. First, there would be Lubitz dealing day to day with the stress of hiding his severe mental illness (which was so severe he had to be monitored over time) from the company. Second, if he fell into a pattern of sleep deprivation this would have directly triggered the "psychotic episode".

Amdist all this many have been asking, as one expert did on CNN this morning:

"Why this tragic communications breakdown between those treating Lubitz and the airline?"

Indeed. And here we also have parallels with the case of Aurora mass killer James Eagen Holmes, who was also being treated for severe psychological illness (at the Univ. of Colorado, Anschutz campus) prior to his rampage at an Aurora theater, slaying 12 and severely wounding dozens.  Why wasn't this information passed on to the proper authorities? The  canned excuse of "patient confidentiality" simply doesn't cut it -especially when the patient had produced violent diaries depicting himself as the "Joker" slaying people in a cinema. This all ought to have been out in the open, shared with the proper authorities.

In like manner, the fact Andreas Lubitz had been issued antipsychotic meds, as well as  been issued an "unfit to work" notice, ought to have been known by Lufthansa.  This was after he'd reported waking up screaming from nightmares.  THEY should have known of his condition in the immediate time sense and by virtue of the medical personnel informing them, not trusting a psycho to share it!  Of course, he would be determined to hide it, as we saw. Thus, this incident will militate in the future for medical professionals to directly share their diagnoses with airlines. No more hiding treatments, or "sick notes".

And no more balderdash that "he was fully fit to fly" - spouted out of abject ignorance  traced to dated information. With much higher scrutiny, including background checks - not just for criminality- this tragedy might have been prevented.

It also might have been prevented had people -e.g.  at least one of his ex-girlfriends, spoken the hell up after he was claimed to have said.

"After tomorrow everyone will remember my name."

Which interjects other famous declaratives issued the day before monumental tragedies, including:

"After tomorrow, those goddamned Kennedys will never bother me again!" - LBJ, night of Nov 21, 1963, to his then mistress Madeline Brown attending a party at Clint Murchison's Dallas home

"By tomorrow our names will be burned in everyone's memory!" - Dylan Kliebold in video diary kept by Columbine killers, Apr. 18, 1998.

Alas, no proactive moves could be made in response to the last, since it was only revealed after the Columbine massacre. On the other hand, timely action for the other two might have stopped an assassination, and a murderous airline crash.

Lastly, this incident is only the most recent in a string of deliberate pilot crashes since 1982 including:

- Feb. 9, 1982:  Japan Air Lines crash blamed on captain declared "mentally unstable" (174 lost)

- Aug.21, 1994, Royal Air Maroc flight intentionally plunged in Morocco by unstable pilot (44 lost)

- Dec. 19. 1997, Silkair plane deliberately crashed off Indonesia. (104 perished)

-- Oct 31, 1999: Egypt Air co-pilot yelling "I rely on Allah" crashed plane with 217 on board into Atlantic Ocean.

- Nov. 29, 2013, Mozambique Airlines captain believed to have deliberately crashed  plane in Namibia, 33 killed.

While these incidents are rare, in terms of general aviation statistics, they do induce dread in people because we disdain the possibility that a psycho might grab plane controls and take us on a one-way trip to perdition. The only way to prevent such events in the future is to delve into personnel backgrounds for signs of psychological  'hiccups' . No airline (or pilot)  squeamishness on this score ought to be tolerated.

No one deserves to be in the position of  an unwilling captive on a flight commandeered by a psychotic, left screaming with fellow victims in the final minutes as they approach their certain doom.  And hundreds of distraught family members left to mourn in the aftermath. We wouldn't tolerate this BS for terrorists, and we shouldn't for psycho pilots or co-pilots!
